Terms and Conditions
All reservations are subject to manager approval. Please note from June 1st to August 24th all reservations will be taken for full weeks beginning and ending on Saturday, unless otherwise approved by Jaqua Management.
RESPONSIBILITY OF RENTER: The person in whose name the reservation is made must be 25 years of age or older, is required to stay at the property for the duration of the rental period, and accepts full responsibility for the actions of all persons on the premises during the stay. Failure to honor this requirement will result in the loss of your security deposit & eviction without refund. Any overnight guests in addition to those registered and in excess of the property’s capacity will result in eviction without refund and loss of security deposit. Renter agrees to be financially responsible for any damages/repairs to this rental property and /or its contents caused by the Renter or Renter’s guest/guests negligence or willful conduct during the rental period. Renter understands that there are special risks that may be involved in using special features, i.e. spa, hot tub, Jacuzzi, whirlpool, pool, gas grills, etc., as well as using other areas of the property. Renter agrees to explain the risks of using the special features to any guest they may have at the property and will be fully and solely responsible for any accidents. Children sleeping on the floor are a hazard to other occupants in the event an emergency exit is required.
SECURITY DEPOSIT: A security deposit of $500.00 is required for each individual property reserved. Security deposits shall be refunded by mail approximately 10 business days after the departure of the individual provided there are no damages, excessive cleaning charges, unreturned keys, phone charges or changes arising from any other disregarded policies.
PROTECT YOUR SECURITY DEPOSIT: The property is inspected upon departure. Please be sure to return furnishings and home accessories to their original location, have all dishes washed, clean the grill, dispose of all trash in the provided container and remove all open food containers from the refrigerator and discard or take with you.
PAYMENTS: Jaqua Realtors Vacation Places & Rentals, LLC accepts payments by Visa, MasterCard, Personal Check, Cashiers Check, Cash or Money Order. For reservations made prior to January 31, 2013, a payment equal to the security deposit is required to reserve the property. A deposit of 50% of the total balance of the reservation (including taxes and fees) is required by January 31, 2013. The second 50% payment is due on or before May 31, 2013.
For reservations made after January 31, 2013, 50% of the total balance for the reserved property (including security deposit, taxes and fees) is required at the time of booking. The second 50% payment is due on or before May 31, 2013, or 30 days prior to the arrival date, whichever is sooner.
Any reservations made after May 15, 2013, require payment in full at the time of booking to confirm the reservation.
You will receive check-in instructions approximately one week prior to your arrival date.
CANCELLATIONS/CHANGES: Cancellations will result in full forfeiture of all monies received unless the property is re-rented. If the property is re-rented for the exact time frame we will withhold the security deposit only. Jaqua Realtors Vacation Places & Rentals, LLC represents the owners of the property serving as a rental agent. Changing your reservation from one property to another is considered a cancellation and all cancellation policies apply. You may wish to consider purchasing travel insurance through your personal insurance agent to protect yourself in the event of unforeseen circumstances.
OCCUPANCY: Rental properties may only be used by the number of adults and children specified on the contract information form. Occupancy and use of the premises and common areas shall not be such as to disturb or offend guests, residents or neighbors. The agent has the prerogative to terminate this agreement and ask disruptive guests to vacate the premises.
CHECK-IN: Check-in time is between 3:00PM and 5:00PM EST. Keys need to be picked up at the Jaqua Realtors Vacation Places & Rentals, LLC, office located at 513 Broadway, South Haven, MI. If you anticipate arriving after 5:00 PM, you must contact the Jaqua office to receive check-in instructions.
CHECK-OUT: Renters/Guests are required to check-out by 10:00AM and keys must be returned to the Jaqua Realtors Vacation Places & Rentals, LLC office located at 513 Broadway. The penalty for late check-outs will be charged $100 per hour after 10:00AM, and will be deducted from your security deposit.
PETS: ALL of our rental properties have a strict NO PETS policy and violators will be subject to eviction and forfeiture of their entire $500 security deposit.
NO SMOKING: For safety purposes and in consideration of the property owners/guests, smoking is prohibited in the rental properties. If you must smoke, please do so outside and dispose of smoking remnants responsibly. Failure to honor this request will result in forfeiture of your security deposit.
NO FIREWORKS: Safety is a concern; therefore, no fireworks are permitted on the rental property and/or the beach at anytime.
HOLD HARMLESS/INDEMNIFICATION: Prices, properties and other specifications are subject to change without notice. In the event that a reserved property subsequently becomes unavailable or uninhabitable due to circumstances beyond the control of Jaqua Realtors, a refund or alternative property may be offered. Jaqua Realtors Vacation Places & Rentals, LLC and the property owner shall be held harmless and be indemnified from any claim, loss, expense, damage or injury resulting from guests’ use or occupancy of the property. Jaqua Realtors will not assume responsibility for loss, delay or expense caused by weather or other circumstances beyond the control of Jaqua Realtors Vacation Places & Rentals, LLC.
KEYS: A $50 fee per key will be charged for lost or non-returned keys. If you lock yourself out of the property and require assistance after normal business hours, the fee will be $50.
PARKING: All vehicles and license plate numbers must be registered with Jaqua Realtors Vacation Places & Rentals, LLC at check-in. Parking is limited and may not exceed the property’s maximum allowable vehicles. Please contact the Jaqua office if you require parking for additional vehicles above the allowable number for your property.
TELEPHONE: Telephones are available in a limited number of properties and will be indicated as such on the property contract. All long distance calls are to be billed to a credit card or the individual’s own home phone.
Local, toll-free, credit card, calling card and outgoing collect calls are free. Jaqua Realtors Vacation Places & Rentals, LLC encourages you to purchase a calling card for your use during the rental period.
REPAIRS: Emergency contact information will be provided in all the rental units. It is imperative the Jaqua Realtors staff be contacted in all emergency situations. Every effort will be made to keep appliances, etc. in good repair. Air conditioners, televisions and appliances cannot be guaranteed and no refund or rate adjustment will be made for mechanical failure unless the refund is authorized by the owner. Should maintenance be necessary, the problem will be addressed as soon as possible after notification.
HOUSEKEEPING: All the rental properties are cleaned prior to arrival. Please maintain the property in a clean and sanitary condition at all times. It is the responsibility of the renter to provide bath towels and beach towels. Most of the rental properties have on site laundry facilities for use.
RIGHT OF ENTRY: Jaqua Realtors Vacation Places & Rentals, LLC or authorized agents may need to enter the property for the purpose of inspection, maintenance or real estate showings. Every effort will be made to prevent any inconvenience or disruption of your vacation.
RENTER AUTHORIZES: Jaqua Realtors Vacation Places & Rentals, LLC to bill charges for security or other deposit to Renter’s credit card.
